Fansti terms of service for creators and fans

Words used in these terms

"Fansti", "we" and "us" mean the operator of fansti.com. "You" means the person using the site.

"Creator" means an account holder who has passed identity and age verification and publishes content for fans.

"Fan" means an account holder who views content and pays creators.

"Agency" means an account that manages creators who accepted its invitation. "Team member" means a person who acts for a creator or an agency through a team seat with the role owner, manager, chatter or editor.

"Content" means anything uploaded, posted or sent through Fansti, including photos, videos, text and messages.

"Fan payment" means any payment from a fan to a creator: a subscription, a pay per view unlock of a post or a message, or a tip.

"Co-performer" means any person other than the creator who appears in content.

You must be 18 or older

Fansti is only for adults. You must be at least 18 years old to create any account, and older if the age of majority where you live is higher. You must also be allowed by the law where you live to view or publish adult content.

Fans confirm their age at the age notice and again when they pay. Creators prove their age with a government ID and a live selfie. We may ask any account holder to confirm their age again at any time and close any account that cannot.

If we learn that an account belongs to someone under 18, we close it at once and remove its content.

Your account

You sign up with your email and a password, then confirm a code we send to your email. You must give accurate information and keep your sign in details secret. Tell us at [email protected] straight away if you think someone else has used your account.

You are responsible for everything done through your account, including actions by team members you invite. One person may hold one fan account and one creator account. Accounts may not be sold, rented, shared or transferred.

Creators show a handle on their page, not their real name. Your legal name and ID stay private and are used only for verification, payouts and legal duties.

Creator verification

Before a creator can publish or sell anything, she must pass verification. This means a photo of a valid government ID and a live selfie, checked by our identity verification provider. The date of birth on the ID must show the creator is 18 or older. Until verification is approved, a creator page stays a draft and nobody can see it.

Every co-performer in any content must either be a verified Fansti creator or have a signed release and a copy of a valid government ID on file with us before the content is published. The release must confirm that the person is 18 or older, agrees to appear in that content and agrees to it being sold on Fansti.

We may refuse or withdraw verification, repeat checks at any time and ask for new documents. Payouts are made only to verified creators, and only to accounts in the creator's own name or her registered business.

Content rules and review

All content must follow our acceptable use policy, which forms part of these terms. In short, you may never post or request content that involves anyone under 18 or anyone who appears to be under 18, non consensual content, hidden camera content, incest themes, bestiality, real violence, the sale of drugs, escorting or offers of in person meetings, illegal weapons or hate.

Every upload is checked against hash lists of known abuse material before it is published. Anything unclear is held and is not published until it has been reviewed. We may decline, remove or restrict any content at any time.

We have zero tolerance for content that sexualizes minors. We remove it, close the accounts involved, keep the records the law requires and report it to the authorities as the law requires.

Anyone can report a post, a message or a profile with the Report button or by writing to [email protected]. How we handle reports is explained on our complaints page.

Who owns content

Creators own their content. Posting on Fansti does not transfer ownership to us.

By posting, a creator gives Fansti a worldwide, non exclusive, royalty free license to host, store, copy, scan, display, deliver and change the format of her content (for example to make previews, blurred teasers and watermarks) only to run Fansti and show the content to the fans she chose. The license ends when she deletes the content, except for copies we must keep for a short time to finish backups, for legal holds, for record keeping duties and for content that a fan already paid for and can still access under these terms.

A creator can delete her content at any time.

Fans get a personal, non transferable license to view content they paid for, on Fansti only. Fans may not download outside the features we offer, record, screenshot for sharing, copy, share or resell content. Sharing paid content elsewhere breaks these terms and may break the law. Creators can ask us to send takedown requests for leaks from their panel, as described on our DMCA page.

The 12 percent fee

Fansti charges a flat 12 percent fee on every fan payment: subscriptions, pay per view posts and messages, and tips. The creator keeps 88 percent of the price she sets. The fee is the same for every creator, from the first sale, and there is no promotional rate that expires.

Creators pay no monthly fee, no plan and nothing upfront. Agencies pay no extra charge.

Each fan payment has a payment processing charge. It is shown to the fan at checkout as its own line and paid by the fan, so it does not come out of the creator's 88 percent.

If we ever change the fee, we tell creators by email at least 30 days before the change applies.

Prices and fan payments

Creators set their own prices within these ranges.

  • Up to 3 subscription tiers, each 4.99 to 199 USD a month, with an optional yearly price
  • Pay per view unlocks on posts and messages from 3 to 200 USD
  • Tips from 5 to 500 USD, with an optional note

Fans pay by card or crypto through our payment processors. The full price, including the processing line, is shown before a fan confirms. Card payments appear on the fan's statement under a discreet billing descriptor.

Fan payments are made to Fansti, which collects them for the creator, takes the 12 percent fee and credits the rest to the creator's balance.

Subscriptions and cancellation

A subscription gives the fan access to the content of that tier for the paid period. It renews automatically at the end of each month, or each year for a yearly price, until the fan cancels.

A fan can cancel any subscription at any time in the library. Access stays until the end of the paid period, and no further charges are made.

If a creator raises a tier price, the new price applies to existing fans only from their next renewal after we tell them. If a creator offers a free trial through a promo link, the fan needs a card on file and the subscription starts at the creator's price when the trial ends unless the fan cancels first.

Payouts to creators

New earnings are held for 7 days before they become available. This protects against chargebacks and fraud.

Creators can choose weekly automatic payouts or request a payout of their available balance. The minimum payout is 50 USD. Payouts go by bank transfer (ACH in the US, SEPA in Europe, SWIFT elsewhere) or in crypto (USDT or USDC) to a wallet the creator controls. Fansti charges nothing for the payout itself. The creator's bank, wallet or exchange may have its own costs.

Where an agency manages a creator, the creator sets the agency share in her panel and we pay the creator and the agency separately. The creator can change or end that share at any time, and the change applies to earnings from then on.

We may delay or hold a payout while we look into suspected fraud, chargebacks, stolen payment details, prohibited content or a breach of these terms. We tell the creator when we do this. More detail is on our payouts page.

Creators are responsible for their own taxes. We may ask for tax information when the law requires it.

Refunds for fans

Fan payments buy digital content that is delivered at once, so they are generally final once the content is unlocked, the subscription period has started or the tip is sent. Where the law gives you a right to withdraw from a purchase of digital content, you agree that delivery starts straight away and that you lose that right once the content is delivered.

We refund a fan payment when the charge was a technical error or a duplicate, when paid content was not delivered, when content was removed for breaking our rules before the fan could access it, or when the law requires a refund.

To ask for a refund, write to [email protected] within 30 days of the charge with the date, the amount and the creator's handle. Approved refunds go back to the original payment method. A refunded amount, and the fee on it, is taken back from the creator's balance.

Chargebacks and disputes

If you think a charge is wrong, contact [email protected] before you contact your bank. We can usually fix it faster.

Filing a chargeback for a payment you made and received is a breach of these terms. While a chargeback is open, we may suspend the fan account that filed it. We may close the account if the chargeback is unjustified.

When a chargeback succeeds, the amount of the fan payment is taken back from the creator's balance, because the money is returned to the fan by the bank. The 7 day hold on new earnings exists so this rarely leaves a negative balance. If a balance becomes negative, we recover it from future earnings.

Agencies and team seats

An agency can manage a creator only after the creator accepts its invitation in her panel. The creator stays the owner of her page, her content and her earnings. She can remove the agency at any time.

Team members act within their role. A chatter can only send messages. An editor can only manage posts. Every action by a team seat is logged and visible to the creator.

The agency and its team members must follow these terms and the acceptable use policy. The creator and the agency are each responsible for what their team members do.

Things you must not do

  • Use Fansti if you are under 18, or for anyone under 18
  • Post, request, sell or share prohibited content
  • Publish content with a co-performer who is not verified and has no release on file
  • Ask for or share personal contact details, or push fans to pay outside Fansti
  • Offer or arrange escorting or in person meetings
  • Harass, threaten, stalk or blackmail anyone
  • Copy, record, scrape or redistribute content
  • Use bots, fake accounts or stolen payment details
  • Get around verification, the age notice, geo blocks, blocks or bans
  • Break the law or the rights of others

Suspension and termination

You can close your account at any time from your settings or by writing to [email protected]. When a fan account is closed, its subscriptions stop renewing. When a creator account is closed, her page and content are removed, and her subscribers stop being charged.

We may suspend or close an account, remove content and hold earnings if you break these terms, if the law requires it, or to protect creators, fans or Fansti. For a serious breach, such as content involving minors, non consensual content or fraud, we close the account at once and may keep earnings linked to the breach as the law allows.

A creator whose account is closed without a serious breach can receive her remaining available balance once the 7 day hold has passed, less refunds and chargebacks. If you think we closed your account by mistake, you can appeal as explained on our complaints page.

After an account is closed, we keep the records the law requires, including verification and co-performer records.

Disclaimers and limits of liability

Fansti is provided as it is and as available. We work to keep it running and secure, but we do not promise that it will be uninterrupted or free of errors, or that any creator will earn a particular amount.

Creators are responsible for their content and their dealings with fans. Fans are responsible for how they use content they unlock.

To the extent the law allows, Fansti is not liable for indirect or consequential losses, lost profits or lost data. Our total liability to you for any claim is limited to the greater of the fees we kept from your account, or the amounts you paid through Fansti, in the 12 months before the claim, or 100 USD. Nothing in these terms limits liability that the law does not allow us to limit, or your mandatory rights as a consumer.

Your responsibility to us

You agree to cover Fansti's losses and reasonable costs from claims by other people that arise from your content, your breach of these terms or your breach of the law.

Changes to these terms

We may update these terms when Fansti, the law or our practices change. We post the new version on this page with its date. For important changes, we tell account holders by email or in the panel before they take effect. If you keep using Fansti after that date, you accept the new terms. If you do not agree, you can close your account.

Governing law and disputes

These terms are governed by the law that applies where Fansti is established, without taking away any mandatory consumer protection you have where you live. Disputes go to the competent courts of that place, unless the law gives you the right to go to the courts where you live.
